TERMS OF SERVICE, PARTICIPATION AGREEMENT & STUDIO POLICIES

By participating in classes, programs, workshops, or events at The Yoga Dance Co., or by using our website or booking platform, you agree to the following terms and policies.
1. PARTICIPATION & ASSUMPTION OF RISK
Participation in activities offered by The Yoga Dance Co. includes, but is not limited to:
Aerial arts (silks, lyra/hoop, trapeze, hammock)
Aerial yoga and aerial dance
Pole classes
Yoga classes
Pilates and barre classes
Workshops, camps, performances, and special events
These activities involve inherent risks including but not limited to:
Falls from height
Equipment malfunction or misuse
Collision with equipment or participants
Muscle strain or injury
Broken bones
Head or spinal injury
Permanent disability
Death
Participants understand that aerial activities involve suspension from rigged equipment and the use of specialized apparatus.
By participating, you voluntarily assume all risks associated with these activities.
2. RELEASE OF LIABILITY
To the fullest extent permitted by California law, participants release and hold harmless:
The Yoga Dance Co., its owners, instructors, staff, contractors, volunteers, landlords, property owners, and affiliates
from any and all liability related to injuries, damages, or losses arising from participation in studio activities, including those resulting from ordinary negligence.
This release applies to all participation in classes, workshops, rehearsals, performances, and studio events.
3. CALIFORNIA CIVIL CODE §1542 WAIVER
Participants expressly waive protections under California Civil Code Section 1542, which states:
“A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor…”
Participants understand they are releasing both known and unknown claims.
4. MEDICAL REPRESENTATION
Participants confirm they are physically capable of participating in studio activities.
Participants are responsible for consulting with a physician regarding any medical conditions that may affect safe participation.
The Yoga Dance Co. does not provide medical advice.
5. EMERGENCY MEDICAL CONSENT
In the event of injury or medical emergency, The Yoga Dance Co. may obtain emergency medical treatment on behalf of the participant.
Participants accept responsibility for any medical expenses incurred.
6. EQUIPMENT & SAFETY POLICY
Participants agree to:
Follow instructor directions at all times
Use aerial equipment only as instructed
Attempt skills appropriate for their level
Avoid altering or tampering with aerial rigging or equipment
Failure to follow safety instructions may result in removal from class without refund.
7. PARENT / GUARDIAN AGREEMENT (FOR MINORS)
Parents or legal guardians registering a minor participant agree to:
Accept full responsibility for the minor’s participation
Assume all risks on behalf of the minor
Ensure the minor follows all studio safety policies
8. PHOTO, VIDEO & MEDIA RELEASE
Participants grant The Yoga Dance Co. permission to photograph or record participation during classes, events, or performances.
Images and recordings may be used for:
Marketing and promotional materials
Social media
Website content
Advertising and studio publications
Participants waive the right to inspect or approve the final materials and acknowledge that no compensation will be provided.
9. CLASS CANCELLATION & NO-SHOW POLICY
Due to limited class capacity and apparatus setup, the following policy applies:
Cancellations must be made at least 8 hours prior to class start time
Late cancellations (within 8 hours) incur a $25 fee
No-shows incur a $25 fee
This policy allows waitlisted students the opportunity to attend and helps maintain fair access to classes.
10. MEMBERSHIP & AUTO-BILLING TERMS
Memberships operate on a recurring billing schedule.
By purchasing a membership, participants authorize The Yoga Dance Co. to charge the payment method on file according to the selected membership plan.
Membership billing will continue automatically unless canceled according to studio policy.
Participants are responsible for maintaining accurate payment information.
11. FAILED PAYMENTS
If a payment cannot be processed:
The system may attempt to reprocess the payment
Access to classes may be temporarily restricted
Memberships may be suspended or canceled until the balance is resolved
Participants will receive notification if billing issues occur.
12. MEMBERSHIP FREEZES
Membership freezes may be available depending on membership type.
Freeze requests must be submitted through the booking system or directly to the studio.
13. PERFORMANCE PARTICIPATION
Certain classes may offer performance opportunities such as showcases or studio events.
Participation in performances may require additional rehearsals, costumes, or agreements.
Performance participation is optional and subject to instructor approval.
14. WEBSITE TERMS OF USE
By using theyogadanceco.com, you agree to use the website for lawful purposes only.
All website content including text, images, and branding is the property of The Yoga Dance Co. and may not be reproduced without permission.
15. THIRD-PARTY BOOKING PLATFORM
The Yoga Dance Co. uses third-party booking systems such as Kenko for scheduling and payment processing.
These platforms may have separate terms and privacy policies.
16. PRIVACY POLICY
The Yoga Dance Co. respects your privacy.
We may collect information including:
Name
Email address
Phone number
Payment information (processed securely through third-party providers)
Payment details are not stored directly by the studio.
Information collected is used to:
Process bookings and memberships
Communicate studio updates
Improve services
We do not sell personal information.
17. STUDIO CODE OF CONDUCT
The Yoga Dance Co. is committed to providing a safe, respectful environment.
The studio reserves the right to remove or suspend participants who:
Behave in a disruptive or unsafe manner
Harass staff or other students
Violate studio policies
18. GOVERNING LAW
These terms are governed by the laws of the State of California.
19. SEVERABILITY
If any provision of these terms is deemed unenforceable, the remaining provisions will remain in effect.
20. ELECTRONIC CONSENT
By registering for classes, checking an agreement box, or participating in studio activities, participants acknowledge that they have read and agree to these Terms of Service and Studio Policies.
Electronic agreement constitutes a legally binding signature.

NO SHOW AND CANCELLATION POLICY
Class Cancellation & No-Show Policy
Because our classes have limited spots and require equipment setup, we enforce the following policy to ensure fairness to all members:
Cancellations
Cancellations must be made at least 8 hours prior to the scheduled class start time.
Cancellations made within 8 hours of class start time will result in a $25 Late Cancellation Fee.
This fee applies to all membership types and class packages.
No-Shows
If you do not attend a class you are registered for and do not cancel in advance, you will be charged a $25 No-Show Fee.
This policy applies regardless of reason unless previously approved by management.
Why This Policy Exists
Our classes have limited capacity and often operate with waitlists. Late cancellations prevent another student from taking that spot and disrupt instructor scheduling.
We appreciate your understanding and commitment to our studio community.
If you need assistance, please contact us prior to class start time whenever possible.
